Terms and Conditions

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to register for or use the Services. By creating an account, you represent and warrant that you meet this requirement. Parents or guardians of minors who access the Services without authorization accept full responsibility for the minor’s activities. You agree to provide and maintain accurate account information, keep your credentials secure, and accept responsibility for all actions under your account. We reserve the right to suspend, restrict, or terminate accounts without notice if we believe they are fraudulent, misused, or otherwise in violation of these Terms.

You agree to use the Services only for lawful purposes and not in any way that violates applicable local, state, national, or international laws. Prohibited conduct includes fraud, scams, sale of counterfeit or stolen goods, harassment of other users, distribution of malware, use of bots or automated systems, attempts to gain unauthorized access, or any conduct that could damage the platform’s integrity. We may suspend or permanently terminate accounts engaged in prohibited activities without prior notice.

CardStream provides a platform that allows buyers and sellers to connect, but unless explicitly stated, we are not a direct party to those transactions. Sellers represent and warrant that they have full ownership and the right to sell the cards they list, and that the items are genuine and accurately described, including set, condition, and quantity. Sellers must ship within the timeframes required by our policies. Buyers must ensure payment authorization and accept that transactions may be delayed or canceled due to disputes, non-shipment, or fraud prevention. We may mediate disputes between buyers and sellers but are under no obligation to do so, and our decision regarding refunds, releases of funds, or account actions is final and binding. Sending proxies, fake or counterfeit cards is expressly prohibited and we'll take steps to protect our buyers from fraudulent activity, fake cards, and/or proxies.

Payments made on the Services are processed through third-party providers, including Stripe. By transacting, you agree to comply with their terms and policies. Fees charged to buyers and sellers, including transaction fees and shipping costs, are disclosed at the time of checkout and may change over time. Sellers are solely responsible for determining and paying any applicable sales, income, or other taxes arising from their transactions, unless we are legally obligated to collect and remit such taxes on their behalf. In the event of chargebacks or payment reversals, the seller is responsible for any associated losses and fees.

Payments from buyers may be captured at the time of purchase and held in escrow until delivery of the purchased items is confirmed, a set period of time has passed, or any disputes have been resolved. Once the transaction is deemed complete, funds are released to the seller’s designated payout account, less applicable fees. We reserve the right to delay or withhold payouts if we suspect fraudulent activity, pending chargebacks, or violations of these Terms. Sellers are responsible for providing accurate payout information and understand that delays or errors may result from inaccurate or incomplete account details.

Sellers must ship items promptly in accordance with our shipping requirements and timelines. Failure to ship may result in order cancellation, buyer refunds, and penalties against the seller’s account. Risk of loss passes to the buyer once the shipment is accepted by the carrier, unless insurance has been purchased and explicitly covers the loss. We are not liable for items lost, stolen, delayed, or damaged during transit unless such items are covered under purchased insurance or a shipping guarantee explicitly provided by us. Cards sold for over $20 are automatically shipped with insurance coverage. Insurance applies only to eligible claims under the carrier’s policy and does not cover losses caused by improper packaging or seller negligence. All shipments must use the shipping labels and services provided by us. We are not responsible for, and disclaim liability for, any loss, delay, damage, or non-delivery of items shipped using unapproved carriers, labels, or shipping methods.

Our scanning, recognition, and pricing tools are intended solely for user convenience. We make no guarantee of accuracy or reliability, and users remain fully responsible for verifying the identity, set, condition, and value of cards before listing or purchasing. Misidentification or scanner error shall not form the basis of any refund, dispute, or claim against us. By using these tools, you acknowledge and agree that we disclaim all liability for errors, inaccuracies, or mismatches that occur.

The Services may include credits, points, or virtual currencies such as 'Manna'. These do not constitute legal tender, are not backed by any government or financial institution, and are not insured by the FDIC or any regulator. They hold no inherent monetary value unless expressly designated as convertible to cash within the Services. We reserve the right to modify, suspend, or discontinue such programs at any time. Users may not sell, trade, or transfer virtual currency outside of the Services. We make no guarantees regarding the stability, value, or availability of such credits.

By uploading or submitting content to the Services, you retain ownership of your intellectual property but grant us a worldwide, royalty-free, sublicensable license to use, display, distribute, and promote that content in connection with the Services. All other content, trademarks, and intellectual property provided by us or our licensors remain their exclusive property. You may not copy, modify, distribute, or reverse-engineer our intellectual property without written permission. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable laws, and may remove content or suspend accounts upon receipt of valid infringement claims.

The Services are provided on an 'as is' and 'as available' basis, without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or free from harmful components. We disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, our total liability to you shall not exceed the greater of $100 or the total fees you paid to us during the six (6) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, data, goodwill, or reputational harm.

You agree to indemnify, defend, and hold harmless CardStream, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, violation of these Terms, or sale or attempted sale of counterfeit, infringing, or illegal goods. This obligation survives termination of your account.

We may suspend, restrict, or terminate your account and access to the Services at any time, with or without notice, for any violation of these Terms, suspected fraudulent activity, or if required by law. Termination may include the forfeiture of virtual currency, cancellation of transactions, or refunding/withholding of escrow funds as deemed appropriate. We are not liable to you or any third party for termination of access or account suspension.

These Terms are governed by the laws of [Insert State/Country], without regard to conflict of laws principles. Any disputes shall be resolved through binding arbitration administered by [AAA/JAMS] in [Insert City/State], except where prohibited by law. You and we agree to resolve disputes on an individual basis only and waive the right to bring or participate in class, consolidated, or representative actions. The arbitrator’s decision will be final and binding, subject to limited judicial review.

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting in the app or on the website, unless otherwise stated. It is your responsibility to review these Terms periodically. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
